President Donald Trump has been sued over a Truth Social service that gives paying customers faster access to his posts, including potential government announcements that can move financial markets.

The Intercept and Freedom of the Press Foundation filed the complaint Wednesday in U.S. District Court in Manhattan. The lawsuit names Trump, White House Deputy Chief of Staff Dan Scavino, presidential executive assistant Natalie Harp, and the Executive Office of the President.
The service is called Truth API. Trump Media launched it on August 1, and it delivers posts from Trump and other major Truth Social accounts faster than they appear to the public.
Customers pay between $60,000 and $100,000 per month. More than 10 customers have signed contracts, mostly high-frequency trading firms, according to Trump Media interim CEO Kevin McGurn.
Constitutional Claims
The plaintiffs argue the service violates the First Amendment by giving paying customers preferential access to presidential statements that may include official government announcements. They say the public and press should have equal access.
A Fifth Amendment claim is also included. The plaintiffs argue the government cannot put a price tag on access to a public benefit. Neither claim has been ruled on yet.
“Nothing could be more antithetical to the free, independent press than the president charging for early access to his public announcements,” said The Intercept Chief Legal Officer David Bralow.
Trump has used Truth Social to announce trade decisions, foreign policy moves, government appointments, and military actions. That makes the timing of his posts valuable to trading firms.
The lawsuit also flags Trump’s financial stake in Trump Media. The Donald J. Trump Revocable Trust holds about 41.43% of Trump Media shares, with Trump as the sole beneficiary. That holding has been valued at over $1 billion.
Prediction Markets and Crypto Plans
Trump Media is now looking at licensing Truth API data to prediction market operators as a new revenue stream. McGurn mentioned the company is evaluating opportunities in the prediction market space but did not give details on what data would be sold.
The company has also pulled back from earlier crypto plans. Trump Media and Crypto.com terminated plans for a publicly traded CRO treasury company and ended the exchange’s involvement in proposed Truth.Fi exchange-traded funds.
Trump Media reported $360.6 million in unrealized and other accounting losses tied to digital assets in the first half of 2026.
Crypto Holdings
Its digital asset holdings were valued at $597.7 million as of June 30. That includes 9,477 Bitcoin worth $557.1 million and 756.1 million CRO worth $40.6 million.
The lawsuit asks the court to declare Truth API unconstitutional and require equal access to official presidential posts.
